Expat OAPs can claim Winter Fuel Allowance

A ruling from Strasbourg following a case by an ex-pat living in Switzerland since 1998 won his landmark case against the Government now means that all ex-pats living abroad can claim the Winter Fuel Allowance even though they are not resident in the UK and living in hot countries. The current ruling was that they could claim if they were resident in the UK when they became OAPs but this is all to change.
The Work and Pensions Secretary is reported to have stated “We will fight these ridiculous EU rules. It is ludicrous we could have to pay more pensioners living in hot countries”.
